    Default Figuring Arrearage for Temporary Spousal Support

    My question involves divorce in the State of:FLORIDA

    After over a yr. I finally got an order for temp support. The order states that the payments were to begin on Jun 4, 2010, but my husband objected so we had to have a hearing in front of the Judge to determine if the Magistrates recommendation and report would be upheld by the Judge. The Judge then entered the order on Oct 13. My husband is making this difficult b/c I have to be like a bill collector to get it. I want to move the court to enter an Income Deduction Order. I am confused about the form. In figuring arrearage, do I count from June 4th or when the Judge actually signed it?

    It's not likely that any collection agency will buy the debt at this point.

    He's likely going to be given SEVERAL chances to get caught up before the court will order an income deduction order.

    Either way, it's going to be from the date the judge actually signed the order.

    I think the mention of "I have to be like a bill collector" was an expression of frustration about how hard it is to get her ex- to pay, as opposed to an expression of a desire to sell the debt to a collection agency.

    If the court ordered payments to (retroactively) begin on June 4 then the arrearage would be the total amount of payments due since June 4 less the amount your ex- has paid. There may be interest on the arrearage; if so, probably only since the order was entered.
