    Default First Time Marijuana Possession, No Ticket

    My question involves criminal law for the state of: Michigan

    I was at a party, and me and 3 other guys left together. Our driver had not been drinking. Literally as we pull out of the drive way ( the house was kinda in the woods) we see a police officer with his lights on waiting. He asked us to roll down the window, where we had been, we told him at a friends party. He then asked when he had last smoked and said the car reeked of weed and then asked to search us. It was not my car, nor the drivers. He did not ask for proof of insurance or either of my other friends IDs. After searching us and not finding any weed, he pulls out a k9 dog and finds my bag underneath the chair in the car. I admit to the bag being mine. 2 pipes, 2g of weed and a 5th of rum was in my bag.

    He swiped my licenses, and took my phone number. He said he would drop the charges if i agreed to help a detective who was suppose to call me. I agreed to help the detective but I basically just said that so I could get away, I almost planned on changing my number. He also handed me a business card and said if the detective does not call in a week I should email the officer. The policeman had no reason to pull us over, he didn't breathalize any of us and he probably knew we were drinking, and most baffling he did not write me a ticket or arrest me. He said happy holidays and let us leave after taking my bag.

    I do not intend on talking to the detective, and its been about 3 days. I talked to a lawyer and she said I shouldn't talk to the detective and she offered to email the police officer for me.

    My question are..
    1. Can a ticket for possession be mailed to me? Since he didn't give me one there.

    2. If he can mail me a ticket, how long can he wait to do so? I don't want to prolong the inevitable but I have hope. The whole situation was very shady.

    3. If i don't email the officer what are the chances of me getting away with this? Think he could forget, or i just slip through the cracks?

    4. Why would he want me to email him? I have a few theories, either he wants me to email him so he can tell me he has to write me a ticket, or maybe he would respond saying that this first time he's going to let me go with a warning but to stay clean. (seems like a fantasy but maybe) or so he can give me a new assignment such as to be involved in a drug sting or snitch out some dealers (i no interest in either situation)

    I sort of want to email him because I figure whats the harm? If he emails me telling me he has to write me a ticket, saw that coming. If he emails me telling i need to cough up the names of some dealers, i'll have my lawyer email him telling him I decline. If I email him telling him I told my parents of the situation and no longer plan on smoking and to stay clean, maybe if hes having a good day hill drop it.

    My parents think I shouldn't email him, and If I have my lawyer email him I'm scared that will just piss the officer off. And if I ignore emailing him all together, will I have a ticket mailed to me or will I have a warrant out for my arrest or something? Or if i ignore him what are the chances of him forgetting the whole situation?

    5. Final question, in your opinion should I email the officer?

    Sorry for so many questions, I have talked to a lot of friends and they all said this is a very weird situation. I am aware of the 7411 first time misdemeanor thing so If going to court is inevitable i'd like to get started with my probation asap because as it stands 4 month from now I'll be 21, so I will be a 21 for 2 months and not able to drink :[. Wow wall of text.

    He could mail you something in the mail,I would just ignore him and not say anything. It's best not to remind him,if he emails you then forward it to your lawyer,any contact say nothing and direct it to the lawyer. Just basically follow the lawyer advice.
