    Default Answer to Unlawful Detainer

    My question involves an eviction in the state of: California

    My nightmare tenant has answered my court summons and now we have a trial date. She's being evicted for not paying rent (she's also a nightmare with the police having been summoned 7 times to her place in the last 60 days). She will claim withholding for repairs, but her claims are baseless. I know she doesn't have the rent. Will I need an attorney or can I fly solo at this portion of the process?

    You're better positioned to make that call than we are. If you do choose to fly solo, check the court's docket and sit through some court proceedings for eviction case on a date (if possible) considerably in advance of the scheduled hearing date for your case. If you feel like you can handle similar proceedings, you may well be right. If not, you may see in action a lawyer who you can consider retaining.

    So we were both without lawyers and the tenant said a lot of baseless things, and we asked either she pay or get out, this was on the 24th of January. It's now the 8th and there is still no judgement. Is this common?
