    Default Possession of a Newly Controlled Substance

    My question involves criminal law for the state of: Texas

    What should one do if him or her bought a substance that was legal at the time of purchasing (from a head shop)? This substance was since put on the list of Schedule I drug list as an emergency health threat? More specifically, this substance is an herb sprinkled with synthetic THC metabolites (JWH-018, JWH-073, JWH-200, CP-47,497, and cannabicyclohexanol). Him or her did not consume any of the substance and it is still sealed in the OEM package.

    Could him or her legally dispose of this?

    Burning it as an incense --- what it is sold as. It is being taken off the market do to deliberate misuse.
