    Default First Offense Traffic Violation in Maryland

    I was coming back from college a few days ago, and was pulled over early in the morning in MD (I am from Delaware). This is my first traffic violation. The officer's car did not have his lights on, which is a law in DE. Will I be able to beat this ticket that way, or is there any way to not get the points assesed, because I cannot afford it with having to pay my way through college.

    We need to know what you received a ticket for--was it for speeding or something else? That will have a lot to do with what type of disposition you may receive.

    It was a speeding ticket that I was issued. 78 in what I thought was a 65, but turned out to be 55.

    I would doubt that the officer not having his lights on is going to have an effect on whether you are found guilty or not guilty of speeding. What the State has to prove is that you were exceeding the posted speed limit.

    Generally, speeding tickets are hard to beat. What you should do first is check with the clerk of the court you are to appear in for the ticket and see whether there is a disposition available where you can keep the points off your record--that is usually the main thing to seek where speeding is concerned. Perhaps they have a program where you could attend driving school or be placed on some type of student probation in lieu of paying fines and costs. Or perhaps you could pay a civil penalty and have it kept off your record this way (civil penalties usually are more costly than standard fines and costs). If you are not able to find out anything from the clerk, find out the name of the prosecutor who handles cases in that court and visit with him/her about these issues. If this fails you may consider calling an attorney who handles traffic cases and see whether they may be able to help you out--in the long haul some money spent now may save you from having to pay more money later.
