    Default Trespass, Vandelisum

    My question involves criminal law for the state of: South Carolina

    2 years ago a relative sold a tractor to another ( no as far a I can tell there is no bill of sale). The relative that sold the tractor yesterday told her brother to go get the tractor so the brother and his 2 friends went to the house where the tractor was and cut a chain that was on it and took it. Other issues are the tractor was behind a shed on private property behind the house. The sheriffs office showed up and advised that due to him having paperwork for the tractor he could take it and seeing the house had no no tresspassing signs up they were allowed to go on the property and take the tractor. The other intresting thing is that one of the actors is a police officer for a town in the county.

    Huh? So are you saying that the relative sold the tractor to a third party and then went and essentially stole it because there is no bill of sale? The relative is a butthole that deserves a good smacking. The person that bought it will have to sue them in court but will have a hard time without a bill of sale. Of course if they have proof of payment that will help.
