    Either you got the wrong item or you did not. Why are you confused?

    If all you're dealing with is threats by the seller, perhaps he's trying to trick you into paying for an item that was not only different from what you ordered but is also now back in his possession.

    You chose not to follow the instruction to tell us what state(s) are involved; as you were told when you posted, laws vary by state.

    I think he is bluffing about a police report. What would he report to the local police? That you returned an item that he says he never shipped? The police really hate getting involved in eBay and Craigslist disputes and usually write them off as civil matters (I avoid them both like the plague - unless I am looking for thieves ... we have solved a number of local crimes by monitoring both).

    Does he still have your money?

    What state are you in and what state is he in?

    The police could care less. That is a bluff and a lie. Besides, you have not done anything wrong.

    Immediatly file a complaint with eBay. If you paid with PayPal, file a dispute with them. If you paid using a credit card, immediately file a chargeback against the seller. Don't allow the seller to play games with you or stall.

    You should certainly be aware of what was being sold and what you received. You know, there are photos and so forth on eBay. This part of your story though is very flaky. I hope you have the tracking number and info on sending it back.

    Although you should tell us what state you are in, state law really is not going to have anything to do with this. This will be handled with eBay and the payment company. Nobody is going to sue someone in another state over 500 bucks.
