    Default Mental Illness and Quitting Your Job

    My question involves labor and employment law for the state of: California

    I don't want to quit my job and actually am very fond of my boss. We have worked together for 8 years. I have bi-polar disorder and though he seems to respect my ability to keep it together at work he will state to others that he "wonder's if I am still taking my meds" do to some error i made in some irrelevant (irrevelant because he never gets back to me about it) calculation (I'm and internal auditor) or something that he never brings up to me. But I am sick of the innuendo and the talk behind my back. If I have to quit because of the stress this causes me can I get unemployment or is that out of reach. I'm 61 and sick of it. NO i can't talk to him. He's not just defensive. He becomes brutal and nasty and it's payback time. And no he's not a doctor and shouldn't be diagnosing me.

    When you asked your employer not to discuss your condition with others, and to come to you first with concerns about your performance, what did your employer say?

    If you quit, you should expect to be denied unemployment.

    from what you said, he isn't diagnosing you. He, at most, is commenting on your demeanor and actions and relating that to a possibility of you having not taken your medication.

    as are a lot of people in the world. The problem is; as long as it is not illegal activity, there is really nothing to stop him from doing it and so far, you have presented nothing that would be illegal.

    If I have to quit because of the stress this causes me can I get unemployment or is that out of reach.
    It would pretty much put it in the "out of reach" category.

    If quitting because your boss was a jerk was good enough to still qualify for UI, I suspect the unemployment rate would go up a few percentage points the moment that was discovered. There are a lot of jerk bosses.

    He stated that he was only kidding. But resumed the remarks after a period of time (I do not know how long). So youre saying that EEOC wouldn't protect me. That's fine. Pretty much what I expected.

    OK then how can I get him to shut up

    You can't. He's not doing anything illegal.
