My question involves criminal law for the state of: California
Two weeks ago my girlfriend asked me to take her to Kohl shopping for cloth for her.
She picked some cloth to try on and at the same time she shoplifted two bottles of perfume and pushed me into taking them to my car. I did it unwillingly. Then while I was standing in line to pay for her cloth, she shoplifted another bottle of perfume and put in her purse which I did not know about it. When we left the store two local security stopped us and asked her to open her purse where they found the perfume. They asked to go inside the store and they called the sheriff. The Deputy insisted on searching my car where they found the tow perfumes. I told the officer every thing. They took us to the sheriff station, finger printed us and issued a petty theft misdemeanor ticket for each one of us with a set date for court. The value of these items is less than $220. I am 65 years old and I have no prior convection. She has other prior offenses but not petty theft. It was stupid of me to listen to her. I am scared to death. I do not want to go to jail. I am in the process of getting an attorney. I will pay Kohl what ever they want. My questions here are:
1- Can my attorney negotiate a deal with the DA where I pay a fine (I do not care how much) and avoid jail?
2- How do I plea?
