I went to court yesterday, absent any legal council. I was given another court date, Feb. 2nd, due to the absence of a PD. I was offered a plea; 1 year of probation, 75 hours of community service, and to pay all court costs, cost of supervision, etc. I think I am still inclined to file for the motion to suppress, I just have had no one to talk to about the matter. Suggestions?
If your entailed to a public defender,I would definitely take advantage of that. During the 2nd court appearance discuss your case with pd . Maybe the resisting arrest can at least be dropped. It sucks imo to get 75 hours of community service for a small amount of weed. At the very least that charge seems like bs,maybe diversion can then be offered for the drug charge. Explain to the pd you never gave consent and feel that your rights were violated. I think pd sometimes get too much grief,there are some very good ones,many are also private lawyers in other cases.
