My question involves criminal law for the state of: Florida
I live in Marion County, Florida. I was sitting outside a friends apartment, a police drove in as my friend was getting up to go inside. The police stopped, got out, and was calling my friend Walter Flowers. My friend said, "I'm not Walter Flowers." and went inside the apartment, the cop started walking up to the porch, he said, "It smells like weed out here!" I said, "I think someone else is smoking because I smell it too." I stood up and went to go inside, since I was not supposed to be the one being questioned. As I put my hand on the doorknob and opened the door, he grabbed my shirt from behind, yanking me back. I went to the ground, I complied with everything he said. He went through my pockets, found about 5 grams of marijuana. I got charged with Possession of marijuana less than 20 grams, Possession of paraphenalia(The sandwich bag??), and Resisting w/o violence. I feel like my rights were violated, and it was all over a mistaken identity, that was not even mine. I don't know if I would have a case for unlawful search and seizure, there were a lot of other people outside too, it wasn't just us. I don't have the money to get a lawyer, so I'm stuck with a public defender. Thanks in advance for any advice.
