My question involves an injury that occurred in the state of: Kentucky
My daughter just recieved papers stating she is being sued over an auto accident that occurred 3 years ago. My daughter rear-ended another car causing minor damage to other car and none to hers. The other driver stated she already had back problems. A police report was filed and that was last she heard of the accident. The other driver never filed a claim with our auto insurance and now that her medical benefits have run out (2008) and from the letter she has no income she is suing forpast and future medical expesnses, past and future physical and emotional suffering, impairment of her power to work and earn money, attorneys' fees and costs and any and all other relief to whish she may appear entitled. My questions is can she file a suit if she did not file a claim with our insurance company? Should she get a lawyer and if so what kind?
