    Exclamation How to Sublease My Room Over the Objection of One Roommate

    My question involves landlord-tenant law in the State of: Indiana. Have 3roommates. I graduated and need to sublease my room in the apartment. My lease and complex allows for subleasing. The rental office told me that I need to get on "ok" from my roommates on the person who has agrees to take over the lease (5-6mons). One of my challenges is that 1 of my roommates is saying, no just be difficult. Do I need their ok - particularly, when 2 out of 3 or ok and the 1 has no reason to say no?

    Does the subleaser have to pay a deposit - do I should I get my deposit back or do/should they keep my deposit until she sublease is up

    You can't move somebody into the apartment without the consent of the occupants.

    You can try playing hardball, letting your roommates know that you've provided X many reasonable replacement roommates, acceptable to the landlord and 2 out of 3 roommates, fulfilling your duties to them, and that if they don't accept one of the roommates you're going to consider yourself relieved of any further duty to contribute to the rent or other bills for the apartment. (I'm assuming you have vacated.) That may inspire the difficult roommate to become more accommodating. Note, however, that until you're released from the lease, even if you can successfully argue that you shouldn't have to give money to your roommates, the landlord can continue to hold you responsible for any delinquent rent, damage, etc.
