My question involves criminal law for the state of: OH
I am currently living in Dayton, OH.
Here's my situation.
I am a F1 student from Western Canada, currently a 4th year medical student in Ohio. Overall, I've been a very active member of the community helping with various health projects and I love animals. I am even the go-to person to housesit cats for several friends and neighbors (I once drove 20 miles 3 times a week to feed a friend's cats for a month). I even have emails from my neighbors (one of them is a MD at the local hospital) thanking me for taking care of their animals.
However, I've been having trouble with one of my roommates and his cat and now he's considering to press animal cruelty charges against me.
Well, I have been very accommodating with my 2 roommates since we moved in last year. However, the male roommate's cat has been causing a lot of problems and arguments between us. Foremost, she has not been trained properly and would bite/attack people when provoked (you know.... when picked up or shoooed away), and she would defecate or urinate everywhere in the house. Personally, I have been bitten 3 times and hospitalized twice due to serious infections (The first time happened when I attempted to pick her up after seeing her urinate on the kitchen counter).
Arguments have broken out regarding the hospital bills and nothing has been resolved.
Last week, the male roommate left home suddenly and expected us to take care of the cat for him. After a couple days, the cat became distressed and began defecating in the carpeted hallway...... I tried to pick her up (I know it's stupid but I am the one who put down the security deposit for the house) and hoped to throw her into her owner's room for the time being. She bit me in the hand again.
I knew that I couldn't afford the hospital bills so I decided to drain the wound myself. I took a couple shot of vodka, and cut the wound to drain the blood. Afterwards, I still wanted to throw the cat into his room because I knew that the cat would either poo or pee somewhere on the carpet again.
I ran to her (intoxicated), grabbed her by her tail. She started hissing, so my first reaction was to press her head down against the floor. I let go a little bit and she jerked again attempting to bite, so I pressed her head down again. Well, at that point, I simply gave up.
The whole thing was somehow recorded on video because the roommate had a hidden camera in the living room, which is another issue I would like to talk to you guys about because I slept with my bf in the living room thinking that no one would be home at one point and I am not sure if that was recorded......
Anyway, the video consists of me
1) running toward the cat
2) grabbing her by her tail
3) pressing her head against the floor twice
The cat herself was not injured. No blood, no bruises, etc. She still runs around in the house, eating the snacks that I hand out to her (yes, I still give her snacks).
However, when the male roommate came back two days ago, I told him about the situation and wanted him to move out by the end of next month. He became infuriated, showed me the video, and said that he will press charges against me on account of animal cruelty
My questions are:
1. Does he have a case against me?
2. If I were to be convicted of animal cruelty, is it going to be a felony conviction?
3. What will happen to my F1 status?!?!? and what about my medical career?!?!?!?!?
