    Default Reaffirmation of a Car Loan in Chapter 7

    My question involves bankruptcy in the state of: WV
    I filled chapter 7 in 2006. At the time i bought a new car but did not reafirm the loan.I still have the car but due to lower income i can not really afford the payments.If i was to give the car back to the bank will i still be responsible for the balance owed if it sells for less at auction?

    Since you did not reaffirm the car loan, but you did not surrender the car when you filed, i am not sure but i think you will not be responsible for the default amount, i am not a lawyer, the loan should fall under the BK at the time you filed.
