    Default Walmart Theft Charges

    My question involves criminal law for the state of: Los Angeles

    Hello,

    I am going to get right to the point,
    On december 21,2010, i was caught stealing a $80 item from a local walmart. I was escorted to the back room where they made me sign papers saying i will not enter the property again and also called the police. The police wrote me a ticket and said i should expect a letter in the mail regarding court dates.

    I am 18 years old living with my parents and i wish to keep them out of this. I can pay up to $500. But what should i do? Should i hire a lawyer/local attorney? should i plead guilty?

    Will I serve time in jail?

    This is my first offense of any type not even a parking ticket or a speeding ticket.

    Please help ASAP.

    Yes.

    should i plead guilty?
    NO. Plead Not Guilty. Your attorney may be able to get you into a diversion program, which would also leave you with a clean record.

    Will I serve time in jail?
    Unlikely.

    how will this effect my F-1?
    You SHOULD be OK, under the petty theft exception for a single offense. This is why you need an attorney.

    how will this affect my GC processing?
    When you are interviewed, you'll need to disclose the theft. Take all of your documentation with you. This is another reason you need an attorney.

    thank you for your response,

    as this is my first time dealing with any situation regarding lawyers and courts, i was wondering...I have visited and talked to an attorney locally and he is charging $2000 to take care of everything and talk to the D.A and settle this hopefully and somehow dismiss the case.

    Is that an appropriate fee?
