My question involves criminal law for the state of: Shoplifiting. 2 1/2 wars ago I was caught takin a few food items from walmart. The total was less than $30. I was given pit which I completed paying a fine, taking a class, and paying a $400 fine. All of Whig I did long before the due date. I have not been in trouble since and honestly have not attempted to take anything since that occurred. Well yesterday I went to a walmart to buy groceries and with money being tight I knew exactly what I could spend. I did not have money for the toothpaste and instead of coming back another time I took it. It was the biggest mistake I have ever made be it was so careless. Apparently this is not what I should be doing because I was easily caught. They totaled up the sum as over $10 because I had gum and other items unopened in my purse but I did not steal those I had purchased from other places prior to going to walmart. I have a good friend who is an attorney and he said he would talk to the head prosecutor before me court date to see what they will allow me to do and if they would offer the pti again. I am about to graduate college, never in any other trouble and also have a baby on the way soon. I am so ashamed and I honesty have never beern more scared and will never do this again. I am seeking counseling and never want to be tempted to steal again but after all this I doubt I ever will. I am just wondering what penalties I am looking at since the first time was dismissed after the pti. Also the amount I took and items will come into play? I am so scared to go to jail over toothpaste and am wondering the severity of my punishment. I am praying the attorney cN work out a deal with his friend the prosecutor.
