    Default Suing the California Franchise Tax Board

    My question involves collection proceedings in the State of: California

    So I've been having issues with the California FTB about income tax from gambling in 1990...I had this debt resolved with the IRS years ago by having an offer in compromise. However, now the FTB is claiming that we owe them money.

    How can one take the California FTB to court?

    You file a lawsuit against them in a court that has jurisdiction over the type of claim you want to bring.

    I'm not sure what you're claiming, though - you seem to be saying that you failed to pay taxes, but that because the IRS settled for less than you owed in unpaid federal taxes the state should no longer pursue your state tax debt.
