    Default Encouraging a Minor to Flee the State to Non-Custodial Parent

    My question involves juvenile law in the State of: California
    First, this is not a couple - but two male friends, one of whom will be 19 in about 3 weeks and the other who is 17. The 17 y/o has run away from home on numerous occasions, and has evaded police and parents with the assistance of the 18 y/o. They are now planning a run across country to the 17 y/o non-custodial parent's house in Virginia (who does not even have VISITATION rights). What are the implications for the 18 y/o?

    Partially depends on how far they get. If apprehended in California then this (at a minimum) applies:

    PENAL CODE: SECTION 277-280

    278. Every person, not having a right to custody, who maliciously
    takes, entices away, keeps, withholds, or conceals any child with the
    intent to detain or conceal that child from a lawful custodian shall
    be punished by imprisonment in a county jail not exceeding one year,
    a fine not exceeding one thousand dollars ($1,000), or both that
    fine and imprisonment, or by imprisonment in the state prison for
    two, three, or four years, a fine not exceeding ten thousand dollars
    ($10,000), or both that fine and imprisonment.

    I'm sure Carl will be along shortly to fill in the additional charges (contributing to the delinquency, aiding, etc).


    If they get OUT of California, then FEDERAL charges can come into play due to the transport of the minor across state lines.

    In other words, the 18 year old could have prison in his future.

    Thanks. This is what I thought... but you know kids, they think they know it all and that we adults are just idiots!

    I just hope the dad can prevent the 'escape'. He's been notified of the intent.
