    Default Cold Air Leaks into the House, is It Considered Habitable

    My question involves landlord-tenant law in the State of: Missouri

    The house I rent is older, and very very drafty. The temperature outside is in the single digits, and so the cold air leaks make the heating bills astronomical. The cracks around the door frame that were letting in cold air were caulked.

    The problem is the not so obvious leaks. The floor of the house near the outside walls is as low as 40 degrees. I don't think anything can be done, short of putting new insulation in the walls.

    Does this make the home uninhabitable, and is my landlord responsible for sealing all of these extreme leaks in the house?

    The issue isn't that the house cannot be heated to an adequate temperature - it's that it's an old, leaky, poorly insulated house that is costly to heat? I've never heard of that being held to be a basis to escape a lease.

    I don't really want to escape the lease, I want adequate repairs, which would probably just involve caulking the space between the floor and the wall. I'm not expecting them to re-insulate the walls or anything. But when it's 0 degrees outside and the floor can't get warmer than freezing, I think that's a problem.

    When you wrote a letter to your landlord, explaining the problems and asking for a timeline for repairs, what did he say?
