    Default Child Custody After Spouse Married a Registered Child Sex Offender

    My question involves a child custody case from the State of: Oklahoma.

    Basically, I am the custodial parent of my two kids, I live in Texas, and have for a few years now, but my custody case was in Oklahoma where my ex resides. Her husband is a registerd child sex offender. His victim was the age of 14-15 when he was 25, but the fact is that my daughter is not his daughter and I don't want her trusting this guy. I have to let them go over to their house in Oklahoma every other weekend, but this just doesn't seem right. I think there is some family law that requires him to vacate the premises or her to hire a court supervisor while children are present. I really need some help on this issue if anyone could help me out that would be great.

    Supervision might be a requirement on HIM, as part of his sentence if he's going to be around chidlren, but all YOU can control happening is what SHE can be ordered to do. If it's not FORMALLY a part of your custody order, it's time to MAKE it be so.

    Check into the terms of his probation (assuming he's on probation). There is no state law saying he must vacate the premises or that visitation must be supervised if he is present.

    The courts expect your ex to protect your child and will trust her to do so as a general rule; again though check into the terms of his probation. If he is not prohibited from being around minors there may be little you can do.

    He is no longer on probation. She got his probation amended about three months before our custody hearing to allow him around the kids and then they told me I could not get it changed when I became custodial parent. So basically he isn't on probation.

    Then I'm not sure you actually have any recourse at all.

    Mom is allowed - generally - to have whomever she wants around the kids. The courts generally trust the parent to protect the kids. The court also apparently does not consider him a threat to your daughter.

    I completely understand where you're coming from - and indeed, your concern - but I'm not seeing much you can do about the situation.

    If this issue was addressed at the custody hearing at which you were awarded custody and the judge found no reason for concern, while your continued concern is understandable what new evidence do you have that might make the court reconsider the prior ruling? If the issue wasn't raised at that time it may have been thereby waived.

    If you are unable to control this through court order, I would look into whether he is violating other laws for which he could be put in jail, at least temporarily. For instance, in my state, sex offenders must register every 3 months and every time they move. Does your state have a registry, and if so, is his address and status current. In my state, offenders cannot live within 1,000 feet of a school. I know of a case in which the offender went to jail for staying at a house 967 feet from a school. Check it out and report him to the police. And, if he violates any law like this, consider motioning the court that he cannot follwo the law and thus cannot be trusted around your kids.

    The last sentence is nonsensical.

    The rest is trying to create trouble where none exists - and frankly the courts do NOT like such shenanigans.
