    Default How to Attain a Motion of Transfer

    My question involves a child custody case from the State of: Illinois-Texas

    A few years ago, custody of my children was granted to their father in the state of Illinois. Right now we're trying to go back to court so I can gain custody so he can join the military. It's a completely uncontested case. The only problem we've run into is trying to get the previous case (From Illinois) transfered to Texas. Everyone I've spoken to was unable to tell us how to go about doing it without legal counsel. So, I was wondering if anyone can explain how this is done.

    Because the kids currently reside in Il, you'll have to conduct the custody transfer in Illinois (The courts there currently have jurisdiction). After the custody transfer is complete, then you can file a motion requesting that Texas accept jurisdiction of the case.

    I'm sorry, I guess I didn't explain the situation well enough. The children currently reside in Texas with me. they've been here for 2 years, so they are considered residents. the case involving their father gaining custody is well over. now, we just need to file the motion to transfer here. But we're quite unsure of the steps we need to take in order to do that.
