Assuming there is no allegation of fraud in your application for or receipt of unemployment benefits, or if you successfully refute such an allegation in the bankruptcy proceeding, there's no reason the overpayment can't be discharged.

Note, however, that the state may retain the remedy of recoupment - that is, if you again seek unemployment in the future you may find that they withhold the first $2,100 of your benefits in order to recoup the prior overpayment.
I'm in Michigan and in the same boat only for more money, but looking to file sooner. I lost my unemployment hearing and have appealed to the state MES board. Can I included the overpayment in Chapter 7 before I know the final outcome? Thanks
