    Default Idaho Divorce, Ex Now Wants Children Hyphenated Names

    My question involves name change laws in the State of: Idaho
    My ex wife, divorced in April, took her maiden name back at time of divorce. Now for "tax, schooling, and travel" reasons is asking me to let her change our female childrens(4 and 6) names to maiden-surname. I told her no. She said she doesnt need my consent and can "serve" me. Do I have options or rights to say no. We currently have joint legal and physical custody and I am involved.

    She will have to prove to the court why changing their names is in THEIR (not HER) best interest.

    Yes, you can object.

    Also, if the response is "what's in the children's best interst..." how does one prove that its for mom's benefit, children are too young to know the difference.

    How can it be in theirs when they are so young?

    You don't have to prove anything - the burden of proof is on Mom.

    If you object, she will have to prove to the court why it is in the best interest of the children.

    Thank you for your responses, I am obviously stressed about this. She has threatened being served and not needing my permission...I told her to do what she had to do but that explaining this name change to our children is not in their best interests.....how could she possibly prove otherwise.....any thoughts or experiences?

    The form I read for Idaho asks why the objector would not support this change. I would have defend my position rather than just object?
