    Default Proper Validation from a Collector

    My question involves collection proceedings in the State of: Texas

    I have tried three times now to get a validation from Midland Credit Management for an account they are collecting on from Verizon wireless. The first letter produced a copy of a bill from verizon, with nothing else. The two subsequent letters stating that I want something proving that they have the right to collect the debt and that I have a contract with either them or the original creditor have gone unanswered. Tonight I began receiving phone calls again from them, and I informed them that they have not properly validated my account. They claim that ALL they are required to send me is a copy of the bill from verizon. I told them that I wanted proof that they can even collect it, and their Texas license number or some proof that they can collect in Texas, and he laughed at me, and told me they didn't have to give me any more than a bill. What is my next course of action? The SOL is up on this in March of 2011. I'm not sure where to go from here. Any help is welcome!

    If you want to delay them, just say that the person they need to talk to is in Iraq in the army .. he'll be back in 3 months...

    If you don't believe they're licensed to collect bills in your state, complain to the AG's office.

    There is nothing in the Federal collections law requiring they provide you with anything of the sort and I could find nothing in the Texas law that would require it either. Per federal law, a response to a demand for validation is simply a statement from the original creditor confirming the name and address of the original creditor.

    Unless I missed something in the Texas law, yes, they have provided proper validation.

    . that is pretty much correct.


    I told them that I wanted proof that they can even collect it, and their Texas license number or some proof that they can collect in Texas, and he laughed at me, and told me they didn't have to give me any more than a bill.
    again, unless Texas is more stringent here than the FDCPA, his response was correct.

    What is my next course of action?
    check the site Mr. K provided to verify their state licensing. If they can collect in Texas, considering paying your debt, if it is valid, might be high in the list.

    The SOL is up on this in March of 2011.
    If they are aware of this, I would think you might be served with a suit prior to March 2011.

    Of course, they don't have to sue you so they may simply quit trying to collect.
