    Default Failure to Come to a Full Stop

    My question involves a traffic ticket from the state of: tx

    Ticket for failure to come to full stop.

    Its a small town under 1000 people. Would guess its a good old boy type of place.

    Driving through rural residental town- only car on the road- didn't even see an officer.

    I believed I came to a full stop before turning right. So it would be my word against officers.

    Told officer we were in town to do community service project.

    Soon after we arrived at the destination that officer and other were parked in the private driveway of the place. Then, they got out of the car to walk around. Thought that was very unusual behavior.

    Looked at ticket. First name is all wrong. The location is also wrong.

    So, do I plead not guilty? Do I bring up the behavior after the ticket was issued?

    I hope I don't sound too sarcastic when I say that I've never seen an officer issuing a ticket without getting out of his/her car and walking around. So I'm not sure why you think that is unusual!!!

    As long as the driver's license number is correct and that it properly identifies you as the driver, then a misspelled first name will more than likely be ruled as a typo (a harmless error), it will be corrected and the case will proceed accordingly!

    The location should be noted as the intersection where the alleged violation occurred. If it is incorrect, then you certainly should make that argument in your defense!

    Well, a not guilty plea would likely require you to appear at the court in the area where you were cited, and as long as you're willing to go to trial (assuming that you do not have the option to have your case adjudicated by mail) then there's nothing to stop you from exercising your right to have them prove their case against you!

    You're free to bring up whatever issue you feel is pertinent. In this case, the "behavior" occurred AFTER the alleged violation and as such, it is not related to the elements of the offense with which you were charged (i.e. the "behavior" is not a defense that the violation did/did not occur). If you feel the officer acted inappropriately, then you can file a complaint with his/her/their department but that will not have much of an effect on your court case!

    The walk around was not at the time of the incident. It happened afterwards at the location where the community service work was being done. It was private property.

    I guess if the officer could not read my drivers license properly and wrote a completely different first name than mine, I could suggest that if he couldn't read a driver's license properly, then how could he see that I didn't come to a full stop?

    I appreciate the other answers.
