    Default Emancipation Law of New Jersey

    My question involves emancipation laws for the State of: New Jersey

    Reading all of the other emancipation questions, I've come to understand that New Jersey does not have a set age to be emancipated unless you have HIV. My age isn't the concern then, is it?

    I'm going to be 15 this month, and I've been through a lot in my lifetime, family wise. I'll spare you the details and just give you this: the police have been to my house on numerous accounts, and dyfs has also.

    My best friend's family has known me for one year now- and they know that even though everything seems smooth on the surface, it's really not. Yesterday, my best friend's mother said to me, "Have you ever thought about emancipation?", and I replied, "Yes, but I don't know how I could support myself and keep up my grades, or where I would stay."

    She told me to disregard this all, and said "I know you could do it, but disregard that all for now. What if someone could provide for you?"

    I'm not sure what my question is, I have tons. If legally, people know what has happened in the past, will it effect my ability to be emancipated? And, if I could get a solid job and keep up solid grades, would that be a requirement?

    I'm not getting ahead of myself- I know I want to be emancipated. I just need to know what I need in order to do this. I'm willing to work for it, even if it longer than a year just to get the right things in place.

    You obviously didn't read the stickies at the top of this forum, however.

    You're friend's mother doesn't know anything about the requirements for emancipation; they aren't something that you can ignore.

    I did read the stickies. They both led to the same exact thread. I'm not just some fourteen year old who thinks her life sucks and needs to get out of her house.
    My friend's mother wasn't telling me to forget about the requirements, but simply asked me if they hadn't existed, would I feel better in that situation?

    I didn't come here to be criticized, I came here for help. I'm asking: would the fact that legally, people have intervened change things at all?

    Many things. Alcoholism, some accounts of child abuse. My parent's aren't divorced but there have been times where my mother had custody, and times when my father has had custody, and neither are really dependable parents.

    There are no statutory provisions for the emancipation of a minor child in New Jersey. That means that there's no method of going to court to petition to be released from the care and control of your parents.

    There have been a few cases where a minor child has been declared emancipated by the courts in New Jersey, but those revolve around children who had ALREADY PROVEN their complete self-sufficiency - they were already working full time, paying market rate rent on an apartment, and fully supporting their other needs (food, clothing, utilities, medical) 100%, without help, and for a period of a year or more.

    Unless you're already on your own and completely self-sufficient, you don't even have standing to go to court to ask to be declared emancipated.
