    Default Where to File for Unemployment if You Don't Live in the State as Your Job or Employer

    My question involves unemployment benefits for the state of: NY, NJ, or FL

    Not really sure where to go with this.

    I live in the state of New York, I commute to work in New Jersey, but the company that I was hired through is located in Florida. I have been working for 2 years, 1 month, and the contract is expiring on the 31st of December - no renewal.

    I get a W-2, not a 1099, and from what I've read that means I'm eligible.

    Which state do I apply in?

    Assuming you file your claim in January, as long as you don't have ANY work wages in NY between October 2009 and Sept 2010, you would file in NJ.

    Yeah, I've worked strictly in NJ (and lived in NY the entire time) from Nov. 2008 until now.
