    Default How to Get a Towing Fee Reimbursement

    My question involves towing laws for the State of: CA


    The other day my car was towed from my parking spot, within my condominium complex, for not displaying my parking permit. I have need to get a temporary permits because this is a new car and I'm still waiting on my registration to arrive. Anyways, when I arrived to my car at the towing yard I noticed that the permit had been sitting face-up in the drivers seat. I usually kept the permit on the dashboard, drivers side, but for some reason it had fallen from the dashboard to the seat. My guess is from the position the car was in when it was towed (the tow truck was not a flatbed so the car was positioned at an angle).

    The HOA rules & regulations for my complex states that I am subject to tow or fine for not properly displaying the permit. It doesn't state where the permit needs to be but if you looked in the car, from the driver's side window, you could see the permit and expiration date with no problem.

    My question is: Do I have a legitimate case to present to Small Claims Court to be reimbursed?

    It is generally not proper to display such things in the driver's seat, so I doubt you will prevail but you can certainly pay the fee and try to make your case to a small claims court judge. My personal thought is that you will lose, or that the management and the tow company will deny seeing it in the driver's seat.

    The permit has always been on my dashboard but for some reason it was sitting on my seat when i picked it up from the tow yard. My fault for not taping it to the window, which i have now done. I had the towing company take a picture of the permit on the seat but im sure he will deny having it.

    I'm not sure how a court will look at it, but it might only cost you $75 and a day off of work to find out.
