    Default Talking at Work

    My question involves labor and employment law for the state of: CA

    I work in a office with 3 other guys. We do technical support for an organization where people call in and we try to solve their computer related problems over the phone or go out and solve on site.

    So their are 4 guys and when their are no calls, we talk. We talk about sports, games, whats for lunch, movies, etc. to pass the time.

    Now we are told that we are not allowed to talk because we need to concentrate on our work. Is this some kind of violation of our civil rights?

    We work and talk at the same time, its not like we ignore our clients while we talk. When receive a call the talking stops and we work. Once the call is done, we continue talking where we left off.

    Can someone tell me what is wrong with us talking? I don't see a problem, work gets done.

    Only your employer can tell you what's "wrong" with you talking at work.

    Regarding the legalities, it's perfectly legal for your employer to require that you don't talk while you're at work, and perfectly legal for your employer to fire you if you violate this requirement - for the simple reason that there are no laws against this.

    Whether or not your employer allows you to talk at work has nothing whatsoever to do with civil rights. Civil rights are all about non-discriminatory treatment - for example if your employer had said only African American employees aren't allowed to talk at work, that would be a violation of the African American employees' civil rights. Your issue bears no similarities to this example.

    No. It is not a "civil right" to talk whenever and wherever you please.

    There are no laws prohibiting your employer from implementing this rule. There are no laws preventing you from being terminated for violating the rule.

    If your employer wants you to not talk at work, you have two choices: clam up, or seek other employment, where the rules are not so draconian.

    My boss is trying to be dictator at work, he's chinese and he adopts the communist way of leading.

    He is perfectly entitled to do so.

    You are perfectly entitled to find another job.

    Your options: 1) Comply. 2) Leave.

    Actually, "dictator" and "communist" are opposites. Your boss can be one or the other, but not both. Nevertheless, as others have said, both management styles are perfectly legal.

    And what's with the "he's chinese" thing? Do you think being Chinese is illegal? That you can sue your boss for being Chinese?
