    Question Ex Wants to Create a Child Support Agreement Without States

    My question involves child support in the State of: Ohio

    My ex is going to begin paying child support. Instead of going through the state, he has asked that we consider doing this together and coming to an agreement. He has our son 3 months out of the year and I am the custodial parent for the school year.

    I know what it has cost me to support our child when I have him. I do not feel that he should have to pay for child support when our son is with him. So I said I would think about it rather than going downtown to request child support.

    Here's my question. If I do make an agreement with him in writing, allowing for an increase every few years, based on his actual income and a little less than what the state would request, can I, go through the state, at a later date, IF he does not follow through with this agreement? Basically, if I do this am I setting my son up for possible problems getting assistance from his father later in life Legally?

    Right now I am trying my hardest to keep things amicable between his father and I. We have both had family members that went through the state for child support and there have been times that there were problems with the state supplied card, money not drawn out, increases without informing families soon enough. Just a mess at times and we want to try and avoid that. I just do not want to put myself or my son in the position of having a problem later in life.

    Court orders protect ALL of you.

    However, you can come to an informal agreement outside of court and this wouldn't bar you from filing in court at a later date.
