    Default How Can I Stop Garnishment on Bank Accounts that Include Social Security Money

    My question involves GARNISHMENT IN WA. I'm retired low income Senior Citizen live in SEATTLE WA. My bank accts. have been garnished little over $7000 ( that include my RETIREMENT Social Security Money + settlement money from past accidents in my savings acct.) . Total garnishment is little over $ 10,000.by Default judgment. Can I stop/ dismiss or even counter sue them in court because my money is exempted by law and force them to pay me back SOCIAL SECURITY MONEY+Accident money+Attorney Fees and Damages caused by garnishment.They got Default Judgment for unpaid hospital bills with My name and JOHN DOE and his WIFE. I'm NOT JOHN DOE. Last Year when I was Hospitlized in ER for heart attack and struggling for my life, this collection agency was sueing me in issaquah court for OLD Unpaid Hospital BILLS. I ignored the summons becouse of name confusion John Doe and his wife. Secondly I was going to see the doctor for treatment every day for long time. Any possibility of defense/winning of the case, I can't afford attorney couse all my bank money have been garnished that include my Retirement Social SecurityMoney+SETTLEMENT MONEY from ACCIDENT, which is EXEMPTED from Garnishment The Court is in ISSAQUAH and Attorney is in Redmond. Please HELP, I have only few days(less than a week ) left to response. Immediate Help Appreciated THANK YOU.

    So you were named in a lawsuit and chose to ignore the lawsuit because other defendants were also named, such that you ended up with a default judgment against you? Then you chose not to try to set aside the default judgment - and further are telling us that you owed the amount claimed in the lawsuit? It sounds like the judgment creditor is on pretty solid ground with that judgment.

    You are free to petition the court to try to argue that some of the funds in the account were from Social Security and should not have been garnished. You've not stated anything so far that would suggest any basis upon which your accident settlement money would be exempt from garnishment - why do you believe it to be exempt?
