    Default Florida Law on Quiet Enjoyment

    My question involves landlord-tenant law in the State of: Florida

    We have called the courtesy officer to hear the noise and they have heard it and went to ask the neighbors to stop (total about 4-7 times). Talked with the apartment manager several times along with apartment staff several times. We are still in our lease, however feel that the "quiet enjoyment" is not happening at all. This happens several times during the week. Dealt with it on some occasions, but other times have called to complain. Twice in a day on few occasions. What can we do? Looking at moving to another apartment or house. Like where we stay, but patience is almost gone.

    Can you give us a better idea of what type of noise you're talking about? "This" isn't very descriptive.

    Have you spoken to your landlord about the steps they might take, such as evicting the other tenant or moving one of you to a different unit?

    The noise we are talking about is they run up and down the stairs, run and jump in their apartment (the kids) for several hours at a time, yell, throw cigarette butts down on our patio, scream, holler and loud music. Yes talked with landlord, no place other apartment for us to moved to and they do not want to lose us or them as renters is what we get told. All they tell us to do is just call when they are loud and they will talk to them. How many talks is there going to be?

    If your landlord is telling you that he doesn't want to lose either of you as tenants and that all that can be done is to keep calling the courtesy officer, I would expect that the "talks" will simply continue until one of you moves out. If the noise is happening during normal hours (usually 8AM to 10PM), and they're normal living noises (like little kids running about from time to time), there's really little to be done for it.

    Consider leaving at the end of your lease term.

    The noise happens during regular hours and after hours (10pm). They are on the 3rd floor and we are on the 1st floor with no one on the 2nd floor. Talks do nothing.
