    Default How to Get Buyer Out of Home when They Don't Make Payments

    We were selling a trailer and land by owner, as is, to someone and she has been late on payments and only gives partial payments. How do we get her to just get out so we can sell to someone through a real estate office? She gives us excuses every month for why she can't come up with the money, yet she bought a new car. We don't know what forms to file because she wasn't a renter, we were selling it to her.Any help would be appreciated.

    You haven't told us anything about your sales arrangement - whether this is something you wrote up on the back of a napkin, or if this is a formally executed and registered land contract. You also didn't follow the instruction to identify your state.

    You should run the documents from your transaction past a lawyer in your state for an analysis based upon the governing contracts and the laws of your undisclosed state.

    Does the new occupant have title to the trailer & land? I dont think that you, as a non-bank, can "foreclose". But I could be wrong

    We wrote a contract saying she would pay $500. a month until it is paid off, with a $50. late fee after 10 days late. Then we both signed it at a bank in from of a notery republic.

    You need to take it to a lawyer. We can't tell from being fed information with a tea spoon. I suspect highly that you should have had legal assistance drafting the contract to begin with and you're certainly going to need one now to get the unlawful detainer or whatever suit you need to evict these folks.
