If they are legally your children you don't need permission from anyone to move including the dad. If you have an agreement with him stating you are going to stay in that state or give him notice of your move than that is what you need to do. And so now Julie... let's talk about all the reasons why you are FLAT OUT WRONG.

1. Once the case is filed, there is a standard restraining order in place for the person filing that includes NOT TAKING THE CHILDREN OUTSIDE OF THE JURISDICTION OF THE COURT. This becomes valid towards the respondent upon service (maybe you should read up on CA law before you start answering questions)...

Not to mention... CA doesn't even HAVE magistrates.
