If I file bankruptcy which will include a debt I am currently being sued for, will I still be obligated to pay it after the bankruptcy goes through? This is a civil case, and the amount keeps going up and up.
The filing of the bk will impose a "stay" therefore the law suit will be stopped. A successful bk (obtaining a discharge) will discharge the debt that caused the suit unless the creditor files a Complaint to Determine Dischargeability and successfully wins a Court Order that the debt is not discharged. If there was any allegation of fraud, breach of fiduciary duty, embezzlement, willful and malicious injury, etc., the creditor will most likely file such a Complaint but the creditor has a limited time in which to do so.
