    Default Impact of Traffic Citation on I-485

    Hello, All:

    I am going for my I-485 interview soon. I have a disorderly conduct conviction (Initial Domestic Assault Charge was amended to disorderly conduct). Now I realized I also had a traffic citation for driving with a suspended license in 2005 for which I paid a fine. I was not physically arrested for this....I was ticketed only.

    Will the payment of the fine for the misdemeanor traffic citation and the disorderly conduct conviction be regarded as multiple convictions for immigration purposes?

    I have final court dispositions for both (and I answered yes on the I-485 application on the arrest question).

    No. The traffic ticket will be mostly ignored.

    You should be more concerned that your initial charge for your disorderly conduct conviction was for Domestic Assault. Expect to be thoroughly questioned about the incident.

    Similar to this case..
    I am in same situation, RECENTLY I have been charged with Traffic ticket - DUTY ON HITTING UNATTENDED VEHICLE (Misdemeanor Case) and was arrested for couple of hours. I am yet to appear in court and hoping to plea bargain for lower charges.

    Will there be any impact later, If I go for Green Card processing or would like to return back to USA on H1B Visa...

    The answer doesn't change. It's a traffic ticket. You have to disclose it, but it won't result in denial of a green card or deportation. It's nothing to worry about.

    Thanks for your explanation. However, you leave me with another question. When you say "be more concerned about your Initial Domestic Assault charge" do you mean the I-485 decision will be made based on the initial charge (to which I pled not guilty) or the final dispostion...conviction for disorderly conduct?

    You'll be asked a lot of questions about the initial charge. The decision won't hinge entirely on it, you should just be prepared to answer a lot of questions about the incident.
