My question involves landlord-tenant law in the State of: Virginia.
The home beside mine is being rented out by two out of state workers who have been in the residence for over a year, living and working in Virginia. About 6 months ago another person showed up at this residence and problems started. These problems are:
In one instance a loud party with music, in which I called the police and they responded and got them to turn the music down. No tickets or formal warnings in writing were issued. I informed the landlord of this and that there was someone else staying at their residence which they were unaware of, they issued the renters a warning but this other person continues to stay there. I dont know if the landlord allowed this or not. I have not spoken to them since, they also basically acted like I made the whole thing up although I have a video of this noise coming from their property.
The other issues relate to this new person staying there, they have a truck with very loud exhaust which is not factory ( which I have an email from Ford Motor company proving) and is in possible violation of Virginia Law § 46.2-1049. This truck wakes me up 5 days a week at 5:30am as this person leaves for work, they park just feet off a virginia state road. I am going to try to get the state police to issue tickets for this.
The other issue is this new "renter" has people visiting all the time parking in the yard of this residence and has damaged the landlord yard and is tracking mud in the public road in the neighborhood making the road dirty, creating tripping hazards for people walking and in possible violation of Virginia law § 18.2-324. I was going to contact the Virginia Highway department to issue the landlords a complaint over this.
Besides contacting the state police and highway department I want to contact the home owners and inform them their renters, especially this third person is disturbing the peaceful enjoyment of my home. I would like to get an attorney to write them a letter, hopefully after tickets have been issued for the exhaust so the fact this person has illegal exhaust has evidence. I would hope they would make them move out but if not I may seek legal action. My questions are: Is it legal for me to contact the homeowners/landlords by attorney letter to inform them of my complaints, also what type of attorney should I hire, real estate? Is it illegal for me to contact a landlord by phone at their home to complain about their tenants? If I have to take legal action do you think I would have a case to sue? I would like to call the landlord and complain but since my last and only conversation with them they dont seem very responsive to my complaints and seem to enjoy their rent money and ignore whats going on at their property since they live in a different county and never visit the residence, which seems very negligent to me.
