    Default Traffic Citation

    My question involves a traffic citation from the state of: Pennsylvania

    Last night at 9:10 P.M. I was pulled over for speeding. Now, I do admit I was speeding and I will take full blame, but when I went home the ticket was for my father. All his information, birth date, driver's license, etc. were on the ticket. First, the car is registered under my father's name and the insurance is under his name too. During the stop, I gave him my licenses and he took it back to the car. I didn't check the ticket till I got home and I noticed the error there.

    So my question is, how can I get the ticket from being out my father's name so he's not punished? Also, would I reply as "not guilty" and have them change it during my court case or should I just call?

    I'd call. If you want to plead not guilty you need to appear. Any thing else will be considered a de facto guilty plea.

    I would recommend your father going to court and defend himself ... he would likely get off. They cannot change the defendant in a case so easily or at all.
    I would not plead guilty as this may result in a ticket on your father's license. He may already have 2 & 3 would lose his license.

    RON is a law enforcemennt officer. (I think)

    A citation in your fathers name actually doesnt NOT require YOU to appear....Ron is giving you advice that will result in the officer being able to amend the ticektn and nail you. Talk to an attorney, you may both be able to get out if it.

    it would be interesting if your father went to court and the cop made it to the stand. "do you see the person you gave a ticket to?" no matter what it could get real fun, either he is honest and says "no" or he doesnt care and says "yes". If he says yes you and your father can state that it was you that got the ticket and not your father. I would LOVE to be a fly on that court room wall.
    If you want there are many ways you can take responsibility, if you want to fight it you have a good chance at beating the system. I would feel that you should take responsibility but after seeing the system go after people that are clearly innocent and the dirty tactics some have used, they can lose a good case once in a while!

    I'm not a cop, he wanted to know how to not get his father in trouble. Yes his father could appear and plead not guilty and fight it, but if the goal is to keep dad out of it, the only way would be to get the cop to correct the citation.

    My mistake.

    He DID NOT say "keep my dad out of it", but rather "not get his dad in trouble". Two different things.

    OP, I agree with in2fords. The officer made a mistake and gave a ticket to your dad. Here is the tricky part: if your dad testifies he might be forced to say that you were the driver. You could then get the ticket. This should be an easy one to beat, but you need a bit of skill to avoid getting trapped. Might be worht you spending a few hundred for an attorney- you learn your lesson AND keep both records clean.
