    Default Probation Violation Proceedings

    Crime: B&E of a Bldg
    Sentence: Jail time, 6 mo house arrest, Complete Drug rehab, pay restitution, 3yrs probation.
    Completed: Jail time, house arrest, drug rehab, 1.5yrs probation, paid 1/2 of the restitution.
    Left Michigan to try to get away from influences around me which resulted in a probation violation. PO told me if I leave don't ever come back or we will arrest you!
    Moved and became a model citizen not even a traffic ticket!
    So 6 years later and I really want to get this resolved, Since moving I have had the same salary paying job, bought a house, Got Married and I have a 2yr old daughter. If I go to Michigan and just turn myself in I will go to jail, My family will loose our house and our car because my wife will not be able to support herself and our daughter.
    I decide to try and resolve this matter and call Michigan, it takes me 4 courts to find one who could even find any info on me. I ask the Secretary of the Judge that sentenced me how I can resolve this situation, she says to turn yourself into the Jail. I ask is there any other way to resolve this, she says no, I said you sure, she says yes.
    So my question is this.
    Is there any other way to get this resolved?
    I live half way across the US now and its been 6 years.
    If I go to jail I will loose my job and everything thus making it much harder to pay the restitution. No reason to take 2 steps forward and 10 steps back to get this resolved when I am willing to do it right now right here.

    Do you know what the revocation of probation is for? Was it for not reporting or not making timely restitution payments?

    What you need to do is to contact an attorney in Michigan and the attorney may be able to work out an arrangement with the prosecutor there to keep the probation going without a revocation occurring. The attorney may be able to get the probation transferred out to where you are now so you can report there. It may be that if all restitution is paid the prosecutor will be willing to terminate the probation. There are many options to explore and I would recommend getting an attorney to negotiate on your behalf. If there is an outstanding warrant for a probation violation sooner or later you are probably going to be arrested on it and wind up in jail for some period of time even if ultimately it is decided not to revoke your probation. So it is best to go ahead and address the problem now as opposed to waiting for something to happen.
