    Default Joint Credit Card Debt and Divorce

    My question involves divorce in the State of: Texas
    My wife filed for divorce. We have agreed on how to split up the property and debt. However, she had agreed to get a personal loan for her half of our credit card debt. Now she says she is unable and will just pay the monthly payments. Problem is, the credit card is in my name with her listed as a user. I am afraid she will choose not to pay in the future and I will get stuck with the debt and it will hurt my credit score.
    If our divorce agreement makes her responsible for this credit card debt and she fails to pay, what would be my options? Would this debt showing against my name hurt my credit when trying to purchase a house?
    What would be my best course of action to protect myself if she can not get a personal loan for her half of our credit card debt?

    You should try to get the debt paid off out of the marital assets, such that there's no joint debt after the divorce. If your ex- defaults on joint debt, the creditors can pursue you even if its "hers" under the divorce judgment. Also be sure that joint accounts are permanently closed, at least insofar as you are concerned - if you're clumsy about closing the accounts, it may be possible for your ex- to reinstate them with you on the account.
