    Default Alienation of Affection Against an Employer

    Don't know if this could really be called "alienation of affection," but here's the situation:

    Husband has been in a relationship with his manager for over 6 months. He has since left the company for a new job. Can a suit be brought against his old employer for encouraging/permitting a corporate culture where such relationships are almost inevitable? What would you call that? I am in a state that does not recognize alienation of affection.

    I don't know of any cause of action whereby you could blame the corporation for the break-up of a marriage. I am also not sure what circumstances would make an affair at work almost inevitable. Depending upon the facts, your husband may have a sexual harassment or hostile workplace claim.

    I suppose the inevitability would come in where it is mandatory/expected that the employee stay over at a hotel for meetings even when within driving distance from home, when there is major alcohol consumption encouraged, when the supervisor in question hosts various parties (only for her direct reports and their guests) where the dress code is entirely inappropriate for any professional gathering. I can back this up with photographs that will make you think we are in a brothel instead of a work-related (attendance required) gathering as well as phone records. This is why I believe that the company has sanctioned this type of behavior.

    My husband denies any physical relationship even though I walked in on highly incriminating circumstances, which is why I don't think that a sexual harassment suit is relevant .
