    Default Terminate Parental Rights in the Easiest Way

    My question involves a child custody case from the State of: Florida

    I have perminate sole custody of my 8 year old son. His biological father lives in another state. He does not pay child support although he has a court order to do so. I have provided for my son from day one. We have absolutely no contact with him. The last time we saw him was more than 7 years ago and heard from him was 4. Also the last time I heard he was incarcerated. I want to get my son a passport so we may travel out of the country mainly to meet our family in Central America but are unable to due to needing this man to give consent. I was told I could run an ad in the newspaper to see about terminating parental rights. How do I go about doing this? Please help I'm desperate to finish this once and for all.

    If you have sole custody, you do not need his permission to obtain a passport.

    You may find that you don't actually have sole legal custody.

    That aside, if you wish to attempt termination of his rights you will NEED an attorney especially since you might need to serve him via publication. That is never a DIY project.

    I've had sole custody since 2005. I went through a 2 year custody battle with this man. I was told by the lady at the court house I needed his permission. So this is good to know. Thank you.

    I just didn't want to have to deal with the long ordeal.

    The passport office shouldn't give you a problem - if you have court papers saying that you have sole custody, you do not need Dad's consent to obtain a passport

    Go here and look at Step 7. Print it out and take it with you, with your proof of sole legal custody. You should be fine.
