    Question Can a Custodial Parent Become Responsible for Support for 18yo Out on Their Own

    HI All,

    I live in Florida and have sole custody of my daughter who is a sr in high school and recently turned 18 , well 6 weeks ago against my will she moved out of my house and in with some friends and stopped attending school but was still enrolled.

    She has now decided that she wants to go live with her father in Indiana and go to school there, so she has unenrolled here and I’m guessing will be enrolling in Indiana once she gets there.

    I have heard that her dad has expressed interest in trying to come after me for support

    My question is can an 18yo really just move out against the will of the custodial parent but then the custodial parent become responsible for child support?

    Our original custody and support orders were from Indiana 17 years ago and we have lived in Florida over 8 years.

    Was dad paying child support prior to this? When did the agreement stipulate support was to stop? Normal would be either 18 and/or out of high school although some can stipulate higher education as well. He is certainly able to come after you for support but it's up to the court to decide.

    An 18-yr old is, by law in every state I know of, considered an adult able to make their own decisions in life. If an 18 year old wants to move out that's fine but the parent no longer legally responsible for them, absent some extenuating circumstance such as physical/mental developmental disability or support arrangement stipulating higher education.

    Dad was ordered to pay 50.00 week back 17 years ago for 2 kids and the order just says until further notice. And is pretty far behind as sometimes I would get it and sometimes not, but I never went after it or never asked for an increase or have ever asked the the medical portion. The other child is 20 and just left home for the Army.

    I have been informed that there are states that you are responsible for your kids beyond 18. I apologize if I caused you any confusion Sandy. Please check into your state's and your ex's states guidelines on this.

    While I don't agree that parents should have any legal burden for their kids beyond 18, absent the circumstances I referenced in my OP, I also recognize that some states choose to have it that way.
