My question involves criminal records for the state of: Rhode Island

Hello, in 2006 I plead nolo contendre to two counts of possession of stolen goods >$500, which is a felony. I was given a deferred sentence agreement which included 5 years of probation/deferred sentencing. Also, I was responsible for something called "Total Assessments", which I have already completed paying on the schedule the court outlined. There was a determination of restitution at $0, so that was cleared, I was also responsible for 100 hours of community service, which I also did and filed with the court.

I was initially on supervised probation, but after three meetings my probation officer put me on unsupervised probation, so basically I saw her in 2006 and that was it.

In 2008, I was with some friends and we were laying on top of an elementary school watching the meteor shower in August (Perseid Shower), we heard some noise -- what sounded like dogs and people shouting, so we took off running. Turns out it was the Police and we were put in handcuffs and the police car, given a summons to appear in court for trepassing and did. Prior to attending court, I immediately ran to my probation officer and told her what happened, letting her know that I was totally sorry and not keen on getting in trouble. She told me she wasn't going to violate my probation an didn't, but the court may do so when reviewing my record, but she doubted it. Subsequently, when arriving at court for the summons all of us got off with a 48a dismissal and I wasn't violated. The judge thought the case was "pointless" as she murmured to the court clerk and I was relieved.

Now, my deferred sentence agreement says in "Special Conditions" area "after five years this case shall be expunged" and it is signed by my public defender and the state prosecutor. (Regarding the possession of stolen goods charge)

My question is in May of 2011, when my probation and deferred sentence agreement runs out, if I go to file paperwork for expungement, can my trespassing charge that was 48a'd prevent me from getting my charges expunged? Also, can I have my probation/deferred sentence agreement violated after the elapsed time runs out?

Also, I understand Governor Carcieri allowed a law to carry in June of 2010 that states that people are eligible for sealed records after their deferred sentence agreement runs out -- would this apply to me?
