    Default Does Co-Habitation with a Spouse Nullify a Legal Separation Agreement

    My question involves a marriage in the state of: Virginia.

    My wife and I have been legally separated for years. Our separation agreement was signed in Virginia. We recently moved back in with each other. Does this nullify our separation agreement along with the custody agreement included in the separation papers?

    Are you talking about an agreement you wrote up between yourselves, or something entered as an order by a court? If it's the former, whatever you agree is what you agree. If it's the latter, consider petitioning the court to dismiss the case based upon your reconciliation.
