    Exclamation Statutory in Georgia

    My question involves criminal law for the state of: Georgia
    The situation involves a female minor(15) and a male (20) who have had sex only once. the female lied about her age and said she was 18. The male also knows of other males who the girl has lied to about her age and had sex with them. The female is now pregnant but her and her family suspect that the first male in question might be the father but they aren't for sure because the female had sex with two other male within a few dys of eachother. They only claim it is the first males child when they around certain people. What course of action can said first male take if charged with rape?

    To hire a really good criminal attorney. The fact that she lied about her age is not a defense in any state; nor does the fact that other males may have succeeded, or preceded, him in having illegal sex with her does not change the fact that he had illegal relations with an underage minor. Whether he is or is not the father of her child is also immaterial to the fact that he is guilty of statutory rape.

    well, except that the child will be proof that the crime occurred AND will also bind the new daddy financially for the next couple of decades.. in prison or not.

    He has owned up to his stupidity in the matter and is willing to take whatever consequences come with this situation. Want I was trying to find out is if there only proof is the pregnacy and he is tested and is not the father what can he expect to face if the family doesn't want to press charges themselves?

    It's not up to the family. The state brings the charges if they think there's a case to be made, regardless of whether the family wants them to or not. Whether the state thinks they have enough evidence (including TESTIMONY of the victim), only the state can answer. It's possible that the state can bring a case against EVERY person who slept with her, whether they're the father of the child or not. Whomever the father is, the state just has "bonus" evidence against that person, in the form of the pregnancy.

    EVERYONE that schtupped the little girl gets to go to prison.
