    Default Can You Get Emancipated in Two States

    My question involves emancipation laws for the State of:Texas and Washington.
    My boyfriend just moved to Texas in August. He is planning to come up for Christmas, but not to return. His father does not have the money to come get him. Also since he will be 17, in Texas he can legally move out. Could he get in serious trouble? Also can he go to court and change his Guardianship?

    No, he can't. The age of legal majority in Texas is 18.
    Could he get in serious trouble?
    Not only could he be nabbed as a runaway, dragged back home, and face the possibility of being charged with delinquency, the people who are stupid enough to take him in can be charged with harboring a runaway and contributing to the delinquency of a minor. Interfering with parental authority is pretty serious - and expensive - business.

    Also can he go to court and change his Guardianship?
    Not without his father's consent, no.

    Texas is one of the states that restricts the jurisdiction of its juvenile courts to children under the age of seventeen, except in relation to certain cases committed before the child turns seventeen, so a seventeen-year-old can end up in limbo - not being a legal adult, but outside of the juvenile court's jurisdiction to compel his return to his home. However, Washington State's juvenile courts have jurisdiction until a child turns 18, so a person who runs away from Texas to Washington could still end up in juvenile court.
