My husband and his ex divorced about 3 years ago. They have 2 children together. The divorce decree entered in the courts stated neither parent could move the children without the other parents permission. Last year the Ex decided she wanted to move to AZ and take the children with her. My husband is in the military and was to deploy with in days of her informing him of this and agreed to let them go, feeling his hands were tied and due to time restraints. The Ex had him sign an agreement she wrote up saying the children could move to AZ with her. This year she wants to move again, this time to VA - and again take the children. My husband is fed up with the constant moves and the strain it is putting on the children. However last week the ex motioned the court to modify the the original parenting agreement to give her physical custody. She has allready moved to VA and the children are with us for the summer. My question is at the end of the summer, if the custody battle is still in progress, can she legally take the children to VA? My husband gave her permission once to take them to AZ but not VA.
