    Default Emancipation and Child Support

    My question involves emancipation laws for the State of:
    NJ

    Hi there, My ex and I have been divorced for more than 14 years. We were divorced in NJ. I live in Maryland now and he lives in Tennessee. We have 3 sons together ages 24, 23 and 21. I've been receiving child support monthly for all three boys since the divorce. But earlier this year, the two older boys decided to move in with their dad and the yougest decided to move here to Maryland with me. All of the boys are enrolled in college. My ex has now decided that he wants to end the child support and emancipate all of them. I have no issue with him wanting to take the child support for the older two, since they reside with him, but isn't he still legally responsible to support the 21 year old? Another concern is that if he emanicipates them, then he's no longer obligated to provide any financial support for them...including college expenses and health insurance coverage. Is that correct?

    The bottom line is that I'd like to just make sure that he help with their college education, and since the 21 year old still lives with me and is going to school, I'd like to get some kind of financial assistance for him.

    When I discussed this with him a few months ago, we had made a verbal agreement that he would assist with the boys education and I would agree to stop receiving the child support. He agreed to add our agreement into papers. Well, he had his lawyer draw up the papers for me to sign, and our agreement wasn't in there. The papers basically say that he'll be obsolved of ANY financial obligation to the boys.

    My question is...Would it be worth it to me to pay the lawyer fees and fight him, or do I just sign the emanicipation papers the way they are and be done with it? Any advice?

    Never take your ex's advice as to your finances.

    Get your own attorney.

    okay so if I get my own attorney, do I have to go to NJ where the divorce took place or can I get one here in Maryland?
